Don Sickler owns the rights to all of Clifford Brown's tunes. He has control over anything in print that was written by Clifford Brown. I am not an expert in copyright law. If you are interested in the legalities of copyright law as it concerns music, you would have to talk to an attorney or someone who knows more about it than myself. I do know that Larue Brown Watson and Don Sickler were very good friends. As you may not know, Clifford Brown's widow Larue Brown Watson passed away last October. There's a lot more to the story but in the interest of respecting others' privacy...
You ask lastly in your post, "And why is it still so unavailable???" Go to my first post and read your answer: "He (ie. Don Sickler) is also the reason you don't see more Clifford Brown material on the market."
Tiny Capers was written by Clifford Brown and was originally copyrighted in 1954.
Without being specific, a court action by a certain individual pulled some of Clifford Brown's Material off the market.
You say you "visited both web sites and fail to see where this Don Sickler is involved with the withholding of Brownie's music." I would guess to say that Don Sickler doesn't think it's anyone's business what he does or doesn't do with music he owns the copyrights to.
Are you familiar with the magazine"Jazz Improv?" Take a look at Volume 3 Number 3 published in 2001. That's the issue with Clifford Brown's picture on the cover. Go to page 205. There is a transcription of Clifford Brown's solo on Daahoud (alt. take) with Don Sickler being credited with the transcription. The credits go on to say that this transcription will appear in Don Sickler's upcoming book of transcriptions of solos by Clifford Brown published by Second Floor Music, 130 W. 28th St. 2nd floor NYC 10001. This was in 2001. Did you see any mention of the "upcoming" book when you visited both sites? I didn't either. There is no book in print as described in the Jazz Improv magazine. However, don't hold Jazz Improv responsible. I contacted them and they told me that they are at the mercy to reasonably believe what Don Sickler told them. They are sorry the aforementioned book never came out, but they have no control over what Don Sickler does or doesn't do. I am personally disgusted that more of Clifford Brown's music is not available, and that some of the little bit that is out there was pulled from the market.
